Terms of Service

The short version. Noctiso is free to use with ads. An optional Premium subscription removes ads and unlocks 4K downloads, cross-device sync, and custom Tuner presets. Subscriptions auto-renew until you cancel — you cancel through the App Store, Google Play, or the Stripe customer portal, depending on where you subscribed. You can use the wallpapers for personal use but not redistribute them or use them commercially. We can change the service or shut it down. Slovak law governs.

Who you are agreeing with

Noctiso is operated by Anthony Eli Rasch — sapplify, sole proprietor registered in the Slovak Republic (IČO: 56665032), PO Box 004, 91501 Nové Mesto nad Váhom, Slovakia. In these Terms, “we,” “us,” and “sapplify” refer to that legal entity. “You” means the person using Noctiso.

Accepting these terms

By accessing or using Noctiso — the website at noctiso.com, the iOS app, or the Android app — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

Noctiso can be used without an account. Creating an account or purchasing a subscription is an additional, explicit step; continued use of the free service is your acceptance of these Terms.

The service

Noctiso is a mood-driven wallpaper feed with an optional story layer. You scroll a stream of curated frames; an algorithm visible to you (the Tuner) learns what holds your attention. Some frames have short pieces of writing attached. You can save frames to a local vault, download them, and set them as your wallpaper. None of this requires an account in v0.1.

Noctiso has a free tier supported by ads and an optional Premium subscription (see Subscriptions & billing). Core browsing, the Tuner, the local vault, and standard-resolution downloads are free; Premium removes ads and adds 4K + portrait downloads, cross-device sync, and custom Tuner presets. You are never charged anything without an explicit purchase.

Accounts

You can use Noctiso without an account. An account is optional for free use and required to subscribe to Premium or to sync across devices. You sign in with your email (via a magic link) or with Apple or Google. You are responsible for keeping access to the email address you sign in with.

You must be at least 16 to create an account. We may suspend or terminate an account that violates these Terms or is used fraudulently. You can delete your account at any time from the account screen or by emailing contact@sapplify.com; deletion removes your synced data as described in the Privacy Policy. Cancel an active subscription through the relevant store before deleting, since deletion does not cancel billing managed by Apple or Google.

Subscriptions & billing

Plans. Noctiso Premium is an auto-renewing subscription offered as a monthly plan and an annual plan. The annual plan includes a 7-day free trial for new subscribers. Current prices are shown on the pricing page and in the app before you confirm; the headline price is the same on every channel, though local taxes and currency conversion may vary.

How you are billed. Where you subscribe determines who processes the payment: on the website, billing is handled by Stripe; on iOS, payment is charged to your Apple ID through the App Store; on Android, payment is charged to your Google account through Google Play.

Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends. Your payment method is charged on renewal.

Free trial. If you start the 7-day annual trial, you will be charged for the first year when the trial ends unless you cancel before then. Any unused portion of a free trial is forfeited when a paid subscription begins.

Cancellation. You can cancel anytime — App Store subscriptions in your Apple ID settings, Google Play subscriptions in the Play subscriptions center, and Stripe (web) subscriptions through the customer portal linked from your account. Cancellation stops the next renewal; you keep Premium access until the end of the period you have already paid for.

Refunds. Refunds are handled by the store you purchased through, under that store's policy (Apple, Google), or for web purchases by us via Stripe. Except where required by law, payments are non-refundable once a billing period has begun. If you are an EU consumer you have a 14-day right of withdrawal; by starting to use Premium digital content during that period, with your consent, you agree that the withdrawal right ends once delivery has begun.

Price changes. We may change subscription prices. We will give notice before a change takes effect, and an increase applies only from your next renewal — you can cancel before it takes effect.

Your content (vault, Tuner)

Your saved vault entries and your Tuner preferences live on your device. We make no claim to them. For anonymous and free users they stay local — deleting your browser data or uninstalling the app deletes them with no copy on our side. If you are a signed-in Premium subscriber, your vault and Tuner state are also stored on our servers to sync across your devices; deleting your account removes them. Our content (frames, stories)

All frames, stories, and other content shown in Noctiso are owned by sapplify or licensed to sapplify, and are protected by copyright and other intellectual property laws.

What you may do

• Save frames to your personal device for personal, non-commercial use.
• Set frames as the wallpaper on your own devices.
• Share a link to a frame, story, or series with friends (the share button does exactly this).

What you may not do

• Redistribute, resell, or sublicense frames or stories.
• Use Noctiso content in any commercial product, advertising, or service.
• Remove or alter copyright notices, AI-generation disclosures, or any metadata.
• Train machine-learning models on Noctiso content without our written permission.
• Use automated scraping to bulk-download the catalog. The image CDN is for individual user fetches; bulk scrapers will be rate-limited or blocked.

Acceptable use

Do not use Noctiso to attempt to interfere with the service or with other users. In particular, do not:

• Probe, scan, or attempt to compromise the security of the service or its infrastructure.
• Send automated traffic that disrupts the service or attempts to exhaust resources.
• Use the service for any unlawful purpose under Slovak law or the law of the jurisdiction from which you access it.

AI-generated content

Most images shown in Noctiso are generated using AI tools and curated by the operator. Each frame in our database carries an ai_generated attribute, which is true for the majority of the v0.1 catalog. Stories attached to frames are human-written in v0.1. We disclose AI generation transparently and reserve the right to expand the human-curated portion of the catalog over time.

Availability & changes

We aim to keep Noctiso available, but we make no guarantee of uptime. We may modify, suspend, or discontinue any part of the service at any time, with or without notice. We may also remove individual frames or stories if their continued availability becomes inappropriate (for example, a third-party rights claim or a quality issue), and may update the catalog without notice as new content is added.

Pre-launch and during v0.1, expect occasional downtime. We will not refund anything since the service is free, and we will not be liable for any loss of access.

Disclaimer of warranties

Noctiso is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranty arising out of course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the content will meet your expectations.

Where mandatory consumer protection law applies (notably the EU consumer rights regime and Slovak consumer protection law), nothing in these Terms limits or excludes a right that cannot be limited or excluded.

Limitation of liability

To the maximum extent permitted by applicable law, sapplify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total aggregate liability for any direct damages will not exceed EUR 100.

Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot be limited under applicable law.

Governing law & disputes

These Terms are governed by the laws of the Slovak Republic, without regard to its conflict-of-laws principles. Mandatory consumer protection law of your country of residence within the European Union is not affected.

Disputes will first be addressed by good-faith negotiation. If negotiation fails, the competent courts of the Slovak Republic have exclusive jurisdiction, subject to any consumer-protection forum rules of your country of residence.

Changes to these terms

We update these Terms when Noctiso changes in a way that affects the relationship — for example a change to subscription terms or pricing. This version (effective 8 June 2026) adds the optional accounts and the Premium subscription introduced in v0.2. Material changes are surfaced in-app and on the website. Continuing to use Noctiso after a change means you accept the updated Terms. The current effective date is shown at the top.
